1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and ViralDM ("we", "us", "our") governing your access to and use of viraldm.app (the "Service").
2. Eligibility
You must be at least 18 years old and have authority to enter into binding contracts. By registering, you represent that you meet these requirements.
3. Account Registration
- Provide accurate, current, complete information
- Keep login credentials secure
- You are responsible for all activity on your account
- Notify us immediately of unauthorized access
- One account per person/business
4. Subscription & Billing
Plans
- Starter: ₹499/month
- Growth: ₹1,499/month
- Agency: ₹4,999/month
Billing
- Subscriptions auto-renew unless cancelled
- Charges apply at the start of each billing cycle
- GST will be added as applicable for Indian users
- Payment processed via Razorpay (no card data stored by us)
Cancellation
You can cancel anytime from dashboard. Service continues until end of paid period. See Refund Policy for refunds.
Affiliate Program
If you participate in our affiliate program, separate terms apply. See Affiliate Program Terms for commission structure (30-40%), 90-day cookie, ₹1,000 minimum payout, and prohibited activities.
5. Acceptable Use
You agree NOT to:
- Spam users with unwanted messages
- Send unsolicited promotional content to users who haven't opted in
- Violate Instagram/Facebook/YouTube terms of service
- Use the Service for illegal activities (fraud, harassment, hate speech)
- Send messages promoting illegal products/services
- Impersonate others or misrepresent identity
- Scrape, decompile, or reverse-engineer the Service
- Resell or sublicense without our written permission
- Exceed API rate limits or abuse infrastructure

6. Your Content
You retain ownership of content (messages, automations, data) you upload. By using the Service, you grant us a limited license to:
- Store and process your content to provide the Service
- Send messages on your behalf via connected platforms
- Use anonymized data to improve the Service
7. Third-Party Platforms
You connect Instagram, Facebook, YouTube, and other platforms at your own risk. We are not responsible for:
- Changes to third-party APIs that break functionality
- Account suspensions by Meta/Google
- Data loss from third-party platforms
You agree to follow Meta and Google policies. Violations may result in your platform accounts being suspended/banned.
8. AI-Generated Content
Our Service uses AI to generate replies. You acknowledge:
- AI responses are auto-generated and may contain errors
- You are responsible for reviewing & monitoring AI output
- We don't guarantee AI accuracy or appropriateness
- AI may produce different results for similar inputs
9. Intellectual Property
All rights, title, and interest in the Service (software, branding, content created by us) remain ours. Our trademarks may not be used without written permission.
10. Disclaimers
SERVICE IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties (express, implied, statutory) including merchantability, fitness for particular purpose, and non-infringement. See full Disclaimer.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for indirect, incidental, special, consequential damages
- Total liability limited to fees paid by you in last 12 months
- Not liable for: loss of profit, data loss, platform suspensions, business interruption
12. Indemnification
You agree to defend, indemnify, and hold us harmless from claims arising from your use of the Service, your content, or your violation of these Terms.
13. Termination
We may suspend or terminate your account if you:
- Violate these Terms or our policies
- Fail to pay charges
- Use the Service fraudulently or abusively
- Cause harm to other users or our infrastructure
14. Changes to Service & Terms
We may modify the Service or Terms anytime. Material changes notified via email/dashboard. Continued use means acceptance.
15. Governing Law & Disputes
These Terms are governed by laws of India. Disputes shall be resolved by competent courts in India.
